This document stipulates the terms and conditions of use of the website hosted at http://www.rialta.net (hereinafter ‘the Website’), the property of the MARÍA JOSÉ JOVE FOUNDATION (hereinafter ‘the Foundation’), with email address [email protected] and Spanish Tax ID No. G-15870140, entered under number 2003/3 on the Single Register of Foundations of Galician Interest.
Website users are provided with certain contents of an informative nature regarding the activities carried out by the Foundation.
These general terms and conditions (hereinafter the ‘General Terms and Conditions’) are for the sole purpose of regulating use of the Website by Users accessing said site.
The General Terms and Conditions are available on each of the Website pages and each time Users enter their data on the forms included therein. Users may read, print, file and accept them online. Users may not effectively enter their data without said acceptance. Access to the Website implies the unconditional acceptance of the General Terms and Conditions that Users declare that they fully understand. Users undertake not to use the website and the services offered therein for any unlawful purposes and to comply with these General Terms and Conditions at all times.
ONE. – TERMS AND CONDITIONS OF ACCESS AND USE
1.1.- The terms and conditions of access and use of this Website are regulated strictly by the legislation in force and the principle of good faith. Users therefore undertake to make proper use of the website. All actions in breach of the law, rights or interests of third parties are strictly prohibited, including, but not limited to, the right to privacy and intellectual property, etc. Examples of prohibited actions include, but are not limited to, the following:
1.1.1.- Actions using any means that may damage the website or via said website result in any type of damage to Foundation or third party systems.
1.1.2.- Carrying out any type of unauthorised direct or covert advertising or commercial actions, spamming or mail bombing with the object of blocking network servers.
1.2.- The Foundation may interrupt access to the Website at any time if it detects use thereof that is in breach of the Law, good faith or these Terms and Conditions.
TWO. – CONTENTS
The contents hosted on the Website have been created and included by:
2.1.- The Foundation, using internal and external sources. The Foundation only accepts responsibility for the contents created internally.
2.2.- Third parties unaffiliated to the Foundation, either via direct website collaborations or hyperlinks, links to other websites or news from other websites that are not the property of the Foundation. Under no circumstances shall the Foundation be liable for contents included in this manner, nor can it guarantee that said links or hyperlinks function correctly. Users wishing to create a hyperlink to the Website on their website shall not use the information available on the aforementioned website for any purpose that is in breach of the Law or good faith.
2.3.- The Foundation reserves the right to modify the Website presentation and settings, as well as its contents and services included therein at any time and without prior notice. Users acknowledge and accept that the Foundation may, at any time, interrupt, disable and/or cancel any of the contents and/or services included on the Website.
THREE. – INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS AND OTHER RIGHTS
3.1.-All intellectual and industrial property and other rights associated with the Website domain and its contents are the property of the Foundation or third parties, and therefore no Users are authorised under any circumstances to make use of them, print or store them on any device that is not intended for their personal and private use. These rights are protected by legislation which, where appropriate, applies to matters of intellectual and industrial property, exploitation rights and other similar rights.
3.2.- The Foundation only authorises access and use of the Website domain contents for service and information purposes, provided that the source is quoted or referred to. Users hold sole liability for the incorrect use thereof.
FOUR. – DATA PROTECTION
Data Controller identity and contact details. All personal details provided (hereinafter ‘Personal Data’) shall be included on an activity register for processing purposes that is the property of FUNDACIÓN MARÍA JOSÉ JOVE (‘THE FOUNDATION’), with registered address at Calle Galileo Galilei, nº 6, Coruña (15008), SPAIN and email address [email protected], holder of Spanish Tax ID No. (CIF) G-15870140, and included under entry 2003/3 of the Single Register of Foundations of Galician Interest.
Processing purposes and legal grounds. The FOUNDATION shall process your personal data in order to administer your registration and enable it to provide you with the services related thereto. Likewise, if you give your express consent by checking the box provided for this purpose, your data shall be used to send you commercial information about FOUNDATION activities, products and/or services. The FOUNDATION shall keep your personal data until you exercise your cancellation rights. You may revoke your consent for the processing of your personal data at any time by send a written request to this effect to the email address [email protected] or to the following postal address: Zapateira Rúa de Laxe 122-124, CP5174 Culleredo, A Coruña, SPAIN. You must include a copy of your ID card or other equivalent form of identification, as well as the minimum contents stipulated in the applicable regulation.
Security Measures. The FOUNDATION shall process your personal data in the strictest confidentiality. Likewise, it has applied suitable technical and organisation measures in order to guarantee the security of your personal data and prevent their destruction, loss and illicit use or alteration. When adopting these measures, due consideration was given to criteria such as the processing scope, context and purposes, the state of the art and any risks that may exist.
International data transfers. The FOUNDATION intends to make a single international data transfer to Google, Inc. in order to use the Google email service. This transfer is licit, as Google, Inc. is listed on the Privacy Shield and therefore guarantees a level of data protection equivalent to that of the European Union.
Rights. You may exercise your rights to access, erasure, rectification, limitation, portability and opposition by contacting the FOUNDATION via the email address [email protected] or the following postal address: Zapateira Rúa de Laxe 122-124, CP5174 Culleredo, A Coruña, SPAIN. You must include a copy of your ID card or other equivalent form of identification, as well as the minimum contents stipulated in the applicable regulation. If you are exercising these rights on behalf of a minor in your charge, you must include a document providing proof of custody (the Spanish official family record book is sufficient). Should your request fail to comply with these requirements, the FOUNDATION may request the corresponding amendments. No charge of any form shall be made for the exercise of your rights. Likewise, if you consider that the Foundation has breached the legislation in force whilst processing your personal data or those of a minor in your charge, you may lodge a complaint before the Spanish Data Protection Agency or corresponding inspection body.
Likewise, I hereby declare and state that the personal data provided to the FOUNDATION are correct and truthful.
